Introduction to the Italian Law system


The aim of the course is to provide students with some essential elements for understanding the Italian legal system. Specifically, the subject of the course will be the study of the Italian Constitution, the structure of Italian Criminal and Civil Codes, as well as some theoretical investigations in criminal and constitutional matters. 

Introduction to the Italian Law system

The two main topics of the course are the understanding of the structure of Italian Civil and Criminal Codes, and the in-depth investigation in matters of Criminal Law with specific reference to the provisions of the Italian Constitution, which explicitly or implicitly defines the applicable general principles. The course will first analyse the Italian Constitution. In this first phase, the general structure and the fundamental principles contained therein will be addressed. Secondly, the six books of the current Civil Code will be given an overview and brief remarks about its history will be made. Thirdly, the structure of the current Penal Code will be examined with extensive references to the principles of the constitutional charter applicable to the matter and to the "dual track" sanctions system. In this phase the basic theoretical information on the crime constituent elements will be provided. Lastly the current value of case law in Italy compared to positive law (civil law) will be dealt with as well as a brief basic comparison with the Anglo-Saxon (common law) system.

Learning Outcomes: recognize the fundamental principles of the Italian; constitution Use Italian Civil and Criminal Law; recognize the basic structure of a crime.

The course is intended for students, scholars or workers who are interested in the topics of the course. No prior knowledge is required as regards Italian Law. Among the monographs, the following are recommended: A. Di Amato, Criminal law in Italy, Cedam, 2015; Aa.Vv., The Italian legal system, London, 1985. Among the other documents: Constitution of the italian Republic Baschiera, Introduction to the Italian Legal System. Allocation of Normative Powers: Issues In Law Finding

The teaching approach will be based on video-lessons without intermediate tests of any kind. It includes five macro-topics, which are in turn divided into several sub-sectors that are explained through individual video lessons.
